Please be advised that the new licensure application for a “Substance Abuse Marketing Service” is now available online from the Department of Agriculture and Consumer Services.
This governs anyone who is providing “substance abuse marketing services” and presently includes in-house call centers and any entity which provides any form of website, radio or television advertising: (1) from Florida; (2) to residents of Florida; or (3) targeting potential customers to patronize Florida-based treatment centers or recovery residences.

HOWEVER, we have been advised that the Department WILL NOT be accepting applications at the present time.
This is the email which I received from the State:
Thanks for reaching out to us. The application itself is done and has been posted. However, we are still working through some of the issues and I would recommend they wait until we have finalized our information which should be by the end of this week. I will personally get in touch with you when this is done. I greatly appreciate your clients’ eagerness to comply with the law! However, in order to avoid them submitting an application and payment ( and going through the process of obtaining a refund) when it may turn out they don’t have to, just let them know they are fine in waiting. I can assure you we will not be taking any enforcement actions until we are all on the same page and clear about what is expected. Please feel free to contact me if you have any other questions!
Notwithstanding, we STRONGLY recommend you download the application and begin to make yourself aware of what information the Department will be requiring.
